Terms of Use

Welcome to Yamito. These Terms of Use ("Terms") govern your access to and use of the Yamito mobile application (the "App") provided by Yamito ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Yamito is a mobile application designed to help parents and caregivers with their baby's solid food journey. The App provides:

• A food library with age-appropriate serving guides and preparation tips
• Meal ideas and recipes filtered by age, allergens, and meal time
• A food journal to track introductions and reactions
• An AI-powered feeding coach for personalized guidance
• Expert guides on feeding topics
• Milk feeding tracking

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Subscriptions and Payments

Free and Premium Tiers

The App offers both free and premium (paid) tiers. The free tier provides limited access to features, while premium subscriptions unlock the full experience including unlimited AI Coach access, the complete food library, all recipes, and expert guides.

Billing

All subscription purchases are processed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase. Subscription plans may include monthly, annual, or lifetime options.

Auto-Renewal

Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID account settings.

Refunds

Refund requests are handled by Apple in accordance with their App Store refund policies. We do not process refunds directly.

Cancellation

You can manage and cancel your subscription at any time through your Apple ID settings.

5. Medical Disclaimer

The App is not a substitute for professional medical advice, diagnosis, or treatment.

All content provided through the App, including but not limited to food recommendations, preparation guides, allergen information, and AI Coach responses, is for general informational and educational purposes only. This content is based on publicly available evidence-based guidelines but should not be relied upon as medical advice.

You should:

• Always consult your pediatrician or healthcare provider before introducing new foods to your baby
• Seek immediate medical attention if your baby shows signs of an allergic reaction
• Not disregard professional medical advice because of information provided by the App
• Not use the App as a substitute for a consultation with a qualified healthcare professional

6. AI Coach Disclaimer

The AI Coach feature provides automated responses based on evidence-based pediatric nutrition guidelines. You acknowledge that:

• AI-generated responses may not always be accurate or applicable to your specific situation
• The AI Coach does not have access to your baby's medical history beyond what you provide
• Responses should be treated as general guidance, not medical advice
• We are not liable for any decisions made based on AI Coach responses
• The AI Coach may occasionally produce incorrect or outdated information

7. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect information about other users
• Submit false, misleading, or harmful content
• Misuse the AI Coach by submitting inappropriate or harmful queries
• Share your account credentials with others

8. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, recipes, guides, and software — are owned by Yamito and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User Content

You retain ownership of any content you create within the App, such as food journal entries, notes, and baby profile information. By using the App, you grant us a limited license to store, process, and display this content solely for the purpose of providing the App's services to you.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an "as is" and "as available" basis without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or completely secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability to you for any claims arising from the use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Yamito, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Yamito operates, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
